PROPERTY IMPROVEMENT GUIDELINES

All changes made to the outside of your home and lot must first be approved by the Design Review Committee (DRC). You can view the Covenants and Restrictions and Amended C&R's  to learn what changes and modifications are acceptable within our community.

Declaration of Covenants, Conditions and Restrictions

The Covenants and Restrictions are, in layman's terms, the rules of the neighborhood. The goal of the Covenants and Restrictions is to protect, preserve, and enhance property values in the community. It is the responsibility of each homeowner to know, understand, and abide by the Covenants and Restrictions.

Overview of Covenants and Restrictions

Any property alteration requires the following: the review and approval of the DRC; all permits and approvals required by City of Smithville Planning and Zoning; and full compliance with all HOA Covenants.

Antennas

    • Antennas are not allowed.

Basketball Goals

    • Must be no closer than 15 feet to the curb.

    • Must be kept in good condition/repair.

    • IN-GROUND

      • Require DRC approval.

      • May not be attached to the home

    • PORTABLE

      • DRC approval not required.

Burn Barrels

    • Not allowed; Burning trash or leaves/grass clippings is prohibited.

​

Common Areas

    • Recreational vehicles, including ATVs, are not allowed.

    • No buildings, fences, play equipment, fire pits, or storage is allowed on common grounds.

    • No clearing of common area space of any kind is allowed.

    • No burning is allowed.

    • No dumping of rubbish, grass clippings, building materials, etc. is allowed.

    • Planting and gardening of any kinds is not allowed.

    • Picnics, fireworks, etc. must be cleaned up and removed at the end of the event.

    • Fireworks must be supervised by an adult.

    • Animal excrement must be picked up and disposed of.

Decks

    • Require DRC approval and City of Smithville permit.

​

Dog Houses, Pens, and Outside Kennels

    • Dog houses allowed with DRC approval.

    • Pens and Kennels are not allowed.


Fences

    • Requires DRC approval and City of Smithville permit.

    • Must not exceed 60 inches (5 feet) in height.

    • Must be black metal

    • Privacy fencing is not allowed.

    • Chain link or wire fencing of any kind is not allowed.

Fire Hydrants

    • Must be visible from the street. This is a safety concern.

​

Fire Pits and Fire Wood

    • Permanent fire pits require DRC approval and must meet all fire codes.

    • Fire wood must be stored out of view from any street.

Mailbox and Posts

    • All mailboxes and posts must be wood color only. (original color at installation by developer)

    • Mailboxes in disrepair, damaged, rusted, or chipped must be repaired or replaced.

Mowing, Trimming, Landscaping

    • Lawns are to be mowed/maintained at no taller than 6 inches.

    • Trimming around home/buildings kept to 6 inches or less.

    • Landscaping projects may require DRC approval. Refer to the Covenants/DRC for guidelines.

    • Shrubbery, trees, plants, etc. may need to be pruned to keep from getting overgrown.

Playgroup Equipment

    • Playground equipment such as a swing set must have DRC approval.

​

Pets

    • No more than 3 dogs, cats, or other such pets allowed on any lot or in living unit.

    • Only housepets are allowed. (No chickens, rabbits, livestock, etc).

    • Not allowed to run at large; Leash required.

    • Waste must be picked up by the owner and disposed of in the homeowner's trash. Animal waste is a health hazard.

Pools

    • In-ground and above-ground pools require DRC approval and City of Smithville permit.

    • All swimming pools must comply with City of Smithville swimming pool codes.

    • All outdoor pools, including in-ground and above-ground pools, shall be surrounded by a 48 inch barrier (fence). This requirement is intended to provide protection against potential drowning and near drowning by restricting pool access.

    • All pumps and other permanent pool equipment must be concealed from public view.

    • Above-ground Pools are considered seasonal. Due to high maintenance and poor appearance, will only be approved from May 1st and must be taken down by October 31st.

    • Inflatable Pools - No DRC approval required. If used temporarily in the front of the home, it must be taken down by the end of the day.

Roofs

    • All homes are to be of the same style and color.

​

Satellite Dishes

    • Require DRC review and approval of location prior to installation.

​

Signs

    • Permanent signing is not allowed.

    • Vendor signs in yards is not allowed.

    • Political signs must be removed after election.

    • Approved Temporary Signs

      • Garage Sale

      • Home for Sale

      • HOA meeting

Street Parking

    • All homes have two or three car garages with four or six parking spaces.

    • It is requested that you park in your driveway. This is for the safety of our children and school buses.

    • Parking closer than 20 feet to a stop sign or intersection is prohibited.

    • Blocking a mailbox, fire hydrant, or driveway is not allowed.

Trailers, Utility Trailers, Boats, Campers, Fifth Wheels, RVs

    • Must be stored out of sight

    • Not permitted in driveways, yards, behind house, or in streets.

    • A one time monthly 48 hour pass for guest visits is available through the DRC.

​

Trash, Rubbish, Grass Clippings

    • Must be disposed of timely and properly.

    • Can not be burned or dumped in common areas.

​

Trashcans

    • Must be stored out of sight.

​​

Yards

    • Front and side yards are to be kept clear of fire pits, toys, bikes, and storage of any kind. 

    • Outdoor patio furniture is approved within reason. Please contact Board for further clarification.
